Relationships are built on trust. One of the most important elements of trust is respect for an individual’s privacy. Select Medical Corporation, its affiliated entities and subsidiaries (collectively, “Select Medical,” “we” or “us”) value our relationship with you and take your personal privacy seriously. The Select Medical Family of Brands, which include our affiliated entities and subsidiaries as well as our joint venture partnerships are listed here.
This Privacy Policy (“Privacy Policy”) describes the Personal Information (defined below) we may collect from you, how we might use or disclose it, your privacy rights and how to exercise them, how we may change this Privacy Policy, and the steps we take to ensure that your Personal Information is protected. This Privacy Policy applies to all users of our platforms and services including Select Medical's mobile application(s), other services, and any website where this Privacy Policy appears or is linked to (collectively, the “Services”). This Privacy Policy does not apply to other websites or platforms that have a different privacy policy.
By accessing or using the Services or providing information about you to us in connection with them, you agree to our Terms of Service and confirm you have read, understand, and acknowledge the data practices described in the most recent version of this Privacy Policy.
“Protected health information” as defined by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) that is created or collected about you by Select Medical in the course of using our Services is not subject to this Privacy Policy, but is instead covered by our Notice of Privacy Practices. This Privacy Policy also does not apply to Select Medical employees, job applicants, independent contractors, interns, volunteers, owners, board members, and other individuals who perform work for us, as well as their dependents, emergency contacts, beneficiaries, or commercial contacts.
CATEGORIES OF PERSONAL INFORMATION WE COLLECT
We may collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device (“Personal Information”). We collect Personal Information when you use our Services, create an account with us, or submit Personal Information to us. We may collect the following categories of Personal Information:
- Contact information and other identifiers. For example, we may collect your name, address, email, phone number, birth date, device identifier, IP address, advertising ID or other similar information. Additionally, when you sign up for an account with Select Medical, we may collect identifiers and passwords used to access your account.
- Commercial, customer records, and preference information. For example, we may collect information about products you purchase, services you receive, and information about your personal activities and/or interests. When you use our Services, complete electronic forms, or communicate with us (for example via online chat, email, phone, or text) we may collect and store certain information about you and the activity you engaged in, such as the nature of your communication, the chat transcript, the purpose of the interaction, and the action we took in response to your inquiry or request.
- Demographic information. We may collect information about your birth date, age, and/or language spoken.
- Payment information. We may collect payment information from you such as credit or debit card numbers, bank account information, and other payment details if you purchase a product from us or receive services from us.
- Device, internet, and network activity information. For example, if you use our websites or apps, we may collect information about the browser, device, and operating system you are using, device identifiers, MAC address, and your IP address. We might collect information at the site you came from, or the site you visit when you leave us. We may collect and record page and app interaction information and other electronic communications and content from your use of the website and app (such as content entry, mouse movements, screen captures, the date, time, and location of your visit, what areas of the websites you visit and for how long, what search terms or other data you enter, and what products or content or links you view and click on), and methods used to browse away from the page. If you use our mobile applications, we may also look at how often you use the app and where you downloaded it. We may also embed technologies (which may include, for example, web beacons, tags, and pixels) in the emails and other communications we or our vendors send to you to help us understand how you interact with those messages, such as whether and when you opened a message or clicked on any content within the message. We may engage or otherwise permit other parties to also collect information in these ways.
- Information you submit, provide, or post. For example, we collect feedback and any other information you provide when you contact us through the Services or on social media including content of in-app messages within our mobile app.
- We collect and develop inferences. Using the other pieces of Personal Information collected about you, we may draw inferences about you, reflecting what we believe to be your preferences, characteristics, predispositions, and attitudes.
- Sensitive information. Some of the information we collect may be considered sensitive information in certain jurisdictions, including, for example, username and password; and/or health-related information.
CATEGORIES OF SOURCES OF PERSONAL INFORMATION
We and our vendors collect Personal Information about you from various sources, directly and indirectly, including from the following categories of sources:
- Information collected directly from you. For example, we collect information if you use the Services, sign up for an account, enter into an agreement (such as a photo release waiver or other documents), participate in a promotion (such as a raffle, sweepstakes, or other promotional program), fill out a survey, contact us, or sign up for our email newsletters and/or our caregiver community.
- Information collected from your devices. Our Services may use software development kits (“SDKs”), cookies, web beacons, and other technologies to passively collect Personal Information about you from your devices and browsers. For more information about our use of cookies and other tracking technologies, see the "Cookies " section of this Privacy Policy.
- Information from our affiliated entities, partners, and service providers. We may receive your Personal Information from other Select Medical affiliated entities and subsidiaries, our business partners (including joint venture partners), service providers and other third parties in connection with one or more business purposes, including making our Services available to you.
- Information about you from other sources. Other parties may give us Personal Information about you. These other parties might include your medical providers (in the event they are referring you to one of our practices), friends or family members if they are referring you to our caregiver network, and other third parties. We may also receive Personal Information from your employer, credit check databases, background check providers, and other parties in the healthcare sector. If you provide us with Personal Information about a friend or family member, you must have their permission to do so.
- We combine information. We may combine information that we have collected offline with information we collect online. Or we may combine information we get from another party with information we already have. We may also aggregate your information with other individuals’ information to understand preferences and trends over time.
OUR USE OF PERSONAL INFORMATION
We may use the Personal Information we collect for one or more of the following purposes:
- To provide you with our Services. We may use your Personal Information to fulfill or meet the reason you provided us with the Personal Information. For example, we may use general location information to improve and personalize our Services to you, such as using your Personal Information to respond to an inquiry from you, or providing location-relevant information and Services to you including our online map features which allows you to see the nearest Select Medical location to you. Additionally, if you activate certain services or additional features, such as the caregiver community, we will use your information to provide those services or features.
- To test, develop, analyze, improve, and provide our products and Services. We may use your Personal Information for the purposes of furthering Select Medical’s business, including creating, operating, delivering, maintaining, and improving our content, products, and Services. We may monitor how our users use our Services including, without limitation, time spent using our Services, pages visited, content viewed, functionality used, and other analytics information. We may also use it to help maintain the safety, security, and integrity of our website, Services, databases and other technology assets, and business or for testing, research, and analysis, including to develop and improve our Services.
- To provide support and respond to your requests or questions. We use information to contact you in response to your feedback or other matters related to our relationship with you (such as about this Privacy Policy or our Terms of Service). If your inquiries or feedback relate to your treatment, purchases, or an account, we may also use your information to address the matter.
- For marketing communication purposes. We may use your Personal Information to send you updates regarding existing products and services, information about new products and services, upcoming events, surveys, and other announcements or inquiries. We may share your Personal Information with our sweepstakes and promotions partners when you participate in those activities.
- To comply with a legal or regulatory requirement or to protect ourselves. Our Services are subject to certain laws and regulations which may require us to process your Personal Information. For example, we may process your Personal Information to comply with employment laws or as necessary to manage risk as required under applicable law.
- To comply with our obligations, administer our websites and services, and for internal operations. For example, we use Personal Information to administer the Services, such as troubleshooting, data analysis, and testing. We also use Personal Information when onboarding and interacting with vendors.
TO WHOM WE DISCLOSE PERSONAL INFORMATION
We may disclose your Personal Information to third parties in the following situations:
- With our affiliated entities and business partners. We may share Personal Information with Select Medical affiliated entities, subsidiaries and our business partners (such as joint ventures and/or promotions or sweepstakes partners). We disclose Personal Information within the Select Medical family of companies for the purposes described in this Privacy Policy.
- With our vendors and service providers that perform services on our behalf. We may share Personal Information with vendors who assist us with the uses of Personal Information described in this Privacy Policy. This may include vendors who send emails for us, help us manage and operate our websites and apps, fulfill purchases, provide advertising or marketing services or place our advertisements on other platforms, provide analytics and search engine support, track advertising impressions, investigate and prevent data incidents, provide physical and digital security services, audit our business and financial statements and provide legal advice.
- CHET Community. If you choose to use the CHET Community service, we will share information like name, username and/or profile picture (if you provide such information in your CHET profile) with the individuals whom you invite to your CHET Community or if you are added to and accept an invitation to a CHET Community. Such information may also be shared with the MyChart platform and any administrative users (e.g. doctors, nurses, medical professionals, administrative professionals, etc.) to enable certain features.
- In the Event of Merger, Sale, or Other Asset Transfers. We may disclose your Personal Information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us about you is among the assets transferred.
- To comply with a legal or regulatory requirement or to protect ourselves. We may also share your Personal Information when we believe that such action is necessary to:
- Fulfill an enforceable government request;
- Comply with the requirements of the law or legal process;
- Protect or defend our legal rights or property, this website, or other users; or
- Protect your health and safety or the health and safety of our users or the general public.+
- We may share Personal Information for other reasons we may describe to you from time to time or as permitted or required by law.
YOUR CHOICES AND PRIVACY RIGHTS
You can opt out of receiving our marketing emails and text messages. To stop receiving our promotional emails, select “unsubscribe” at the bottom of the email or follow the instructions in any promotional message you get from us. If you receive promotional text messages from us, you may opt out by replying “STOP”. Even if you opt out of getting marketing messages, we will still send you transactional messages. DATA RETENTION
We keep Personal Information as long as it is necessary or relevant for the practices described in this Privacy Policy, including, for example, for legal compliance, dispute resolution, contract enforcement, backup, archival, and other internal operations purposes. We also keep information as otherwise required by law.
COOKIES, TRACKING AND ANALYTICS
A cookie is a small string of information that the website you visit transfers to your computer for identification purposes. Cookies can be used to follow your activity on the website, and that information helps us to understand your preferences and improve your website experience. Cookies are also used for such activities as remembering your username and password, if you use such a feature on this site.
To gauge the effectiveness of this website, we may collect information about our website users using tracking and/or analytics services. This information may include, among other things, your: interests, language, location, IP address, browser type, internet service provider (ISP), domain names, referring/exit pages, operating system, date/time stamp, and clickstream data. We use these tools to generate various reports on the traffic coming to our web properties to study user behavior, ways to improve our websites, our conversion metrics, and the effectiveness of digital marketing campaigns.

Some browsers have “do not track” features that allow you to tell a website not to track you. These features are not all uniform. We do not currently respond to those signals.

Global Privacy Control. We have the capability to respond to Global Privacy Control (GPC) signals received from various web browsers. If the signal is received, you will be automatically opted-out of all Marketing and Functional Cookies. To use GPC, you can download an internet browser or a plugin to use on your current internet browser and follow the settings to enable GPC.

If you are a California resident, please note the following regarding how we collect, use, and disclose your Personal Information as described in this Privacy Policy, including in the previous 12 months:
- We may collect, use, and disclose for our business and commercial purposes, categories of Personal Information as set forth under California Consumer Privacy Act (“CCPA”), including: Identifiers; payment and customer records information; characteristics of protected classifications under California or federal law (such as demographic information like age, gender, and disability); commercial information; internet or other electronic network activity information; geolocation data; audio, electronic, visual, thermal, or similar information; inferences; and sensitive personal information such as precise geolocation. - We collect and use these categories of Personal Information for the business and commercial purposes described in the "Our Use of Personal Information" Section of this Privacy Policy.

- We may “sell” or “share” categories of Personal Information, including: Identifiers; commercial information; internet or other electronic network activity; geolocation data; and inferences. We may “sell” or “share” these categories of Personal Information to the categories of third parties described in the "To Whom We Disclose Personal Information" Section of this Privacy Policy for the purposes described in the "Our Use of Personal Information" Section of this Privacy Policy. - We may collect, use, and disclose for our business purposes described in the "Our Use of Personal Information" Section of this Privacy Policy the following “sensitive personal information” (as defined in the CCPA): username and password; precise geolocation; and information concerning a consumer’s health not subject to HIPAA.
- If we process deidentified data, we will maintain such data in deidentified form and not attempt to reidentify it.
Subject to limitations and exceptions set forth in applicable law, California residents may make the following requests with respect to their Personal Information:
- Access. You can request that we disclose to you the categories of Personal Information we collected about you, the categories of sources from which we collected the Personal Information, the categories of Personal Information we sold, shared, or disclosed, our business or commercial purpose for collecting, selling or sharing the Personal Information, the categories of third parties to whom we disclosed the Personal Information, and the specific pieces of Personal Information we collected about you. Subject to exceptions under the CCPA, we will provide your Personal Information in a format that is readily useable.
- Deletion. You have the right to request that we delete your Personal Information that we collected from you and retained, subject to certain exceptions.
- Correction. You can request that we correct inaccurate Personal Information that we maintain about you, subject to certain exceptions.
- Do Not Sell or Share My Personal Information. You can request that we not sell or share your Personal Information. For purposes of this California Privacy Rights Section, “sell” means the sale of your Personal Information to an outside party for monetary or other valuable consideration, and “share” means the disclosure of your Personal Information for cross-context behavioral advertising purposes, subject to certain exceptions set forth in applicable California law.
- Cookie-based Opt-Out: If you would like to make a request to opt out of sale, or opt out of sharing of cookie-based tracking for behavioral advertising purposes, click the “Your Privacy Choices” link in the footer of each Select Medical website you visit to set your preferences or broadcast an opt-out preference signal recognized by Select Medical, such as a Global Privacy Control signal, on browsers or browser extensions that support such a signal. In order to identify you within our systems, you may need to provide your first name, last name, email, address, and phone number. We may request additional information if we have trouble finding you in our systems. We may also deny certain requests, or fulfill a request only in part, based on our legal rights and obligations. For example, we may retain Personal Information as permitted by law, such as for tax, auditing or other record keeping purposes, to maintain an active account, to process transactions and facilitate your requests, to meet our legal and regulatory compliance purposes, for fraud detection, investigation, and prevention, and in accordance with our data retention policies. We may also anonymize certain information as needed.
Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information. We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or the authority of the person who is making a request on your behalf (e.g. an authorized agent). The verification steps may vary depending on the sensitivity of the Personal Information and whether you have an account with us. If you choose to exercise your rights through an authorized agent, we may require that you provide the agent with written permission to do so, and that the agent verify their own identity with us. If your request is submitted by an agent without proof that they have been authorized by you in to act on your behalf in accordance with the CCPA, we may deny the request. We also reserve the right, in our sole discretion, to reach out to you directly to confirm that the agent is in fact authorized to make this request on your behalf to the extent allowable under the CCPA, including where verification is insufficient or the nature of the Personal Information subject to the request is sensitive in nature.
Making a verifiable consumer request does not require you to create an account with us. We use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
Non-Discrimination. We will not discriminate against you for exercising any of your California Privacy rights.
California Shine the Light. If you reside in California, you also have the right to ask us one time each year if we have disclosed personal information to third parties for their direct marketing purposes. Indicate in your letter that you are a California resident making a “Shine the Light” inquiry.

Residents of Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah or Virginia, may make certain requests with respect to their Personal Information in accordance with applicable law and subject to exceptions set forth in such applicable laws, including:
- Access/Confirmation of Processing, Deletion, and Correction Requests: Subject to exceptions under the law, you may request that we confirm whether we process your Personal Information, and you may further request access to, or deletion of, your Personal Information. Maryland residents may request a list of categories of third parties (as defined in applicable law) to whom we have disclosed personal information. These categories of parties are described in Section 4 of this Privacy Policy. Minnesota and Oregon residents may also request a list of third parties (as defined in applicable state law) to whom we have disclosed personal information. - Opt-Out of Sale: You may request to opt-out of the “sale” (as defined in applicable state law) of your Personal Information as described below.
- Opt-Out of Targeted Advertising: We may use Personal Information obtained from or in connection with your activities across unaffiliated sites to send more relevant advertising to you.
You can request that we stop using your Personal Information for such targeted advertising as described below and by clicking the “Your Privacy Choices” link at the bottom of our websites.

We also reserve the right, in our sole discretion, to reach out to you directly to confirm that the agent is in fact authorized to make this request on your behalf to the extent allowable under applicable state law, including where verification is insufficient or the nature of the Personal Information subject to the request is sensitive in nature.
Making a verifiable consumer request does not require you to create an account with us. We use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
If you are a resident of Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas or Virginia and are not satisfied with the outcome of your request, you may submit an appeal by sending an email to [email protected] with “Data Privacy Appeal” in the subject line.
Non-Discrimination. We will not discriminate against you for exercising any of your privacy rights.
SUPPLEMENTAL NOTICE FOR NEVADA RESIDENTS
If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Information to third parties who intend to license or sell that Personal Information. You can exercise this right by contacting us at [email protected] with the subject line “Nevada Do Not Sell Request” and providing us with your name and the email address associated with your account. Please note that we do not currently sell your Personal Information as sales are defined in Nevada Revised Statutes Chapter 603A. If you have any questions, please contact us as set forth below.
